Can someone be given the 'right to use' the common space

26-Jul-2023 (In Civil Law)
Dear Sir I have a flat in a cooperative society. We have one parking given with one flat. Now the board of the society says that they have 25 extra open parking spots and the board of society is demanding one lac rupees for an extra parking from those who want an extra parking. I have read that open parking can not be sold but given to use as common area. When I raised this point board replied we are not selling the parking but only giving right to use. I think they have just replaced the word 'selling of parking' with 'right to use'. My question is 1. Can the board charge one lac for right to use? 2.If my objection is valid how can I stop this? Thanks ..........................

On the above-mentioned query, 1. The board cannot charge any amount after agreement or sale of the flat of any of the society or building or apartment.
2. Your objection is valid and you'll go to the RERA TRIBUNAL against the board members of the cooperative society for your rights.
