Can i sue my bank for false CIBIL rating affecting loan for my son

20-Jun-2023 (In Civil Law)
Credit card issue. after clearing bill too after 12 years shown outstanding on my name and reflected in CIBIL During this period no recovery process by bank nor suit filed/decree obtained. Due to this CIBIL rating my credibility is lost in the society. Can I file a civil/Cosumer Forum case against the bank (Credit Card),RBI for defects in the system (being controller of all banks), CIBIL Dept. who upload the rating without proper verification, Auditors of the Bank who certified the outstanding even after 12 years which is against low of limitation. and can it be filed under PIL as there may be so many affected citizens. On writing letter to bank they have reversed the outstanding and given me a letter stating that there is no outstanding on my name as on date. Due to this my Foreigin education loan form for my Son is getting rejected due to SIBIL report. Due to letter restriction not in a position to explain the case very clearly..

Yes, you can approach the Consumer Forum against the bank who is showing wrong information and for harassment, mental agony and loss incurred due to the mistake of the bank. BUt please make sure that you produce all the relevant documents along with your petition and reason for delay in filing the petition.
