Can a Department file an appeal in supreme court against the judgement

01-Feb-2023 (In Civil Law)

Respected Sir, I won a case reg. service matter in CAT. The Deptt. filed an appeal in Hon’ble High Court, but the Deptt. lost the case again. The judgment was delivered by Hon’ble High Court on 07 Sept., 2015. Subsequently, a contempt petition was filed against the concerned Deptt.by me. The hearing of this contempt petition has been fixed on 25 Feb., 2016. Now I desire to know whether the Deptt. can file an appeal challenging High Court’s judgment in the Hon’ble Supreme Court or not keeping in view the limitation of 90 / 60 days.

The Department has to file the appeal within a period of 60 days. Since they have not appealled, so the department cannot appeal now.
