Builder has forcibly occupied office and car porch how to take action
25-Aug-2023 (In Civil Law)
A year back I purchased the apartment in Bangalore and has been handed over to me We have in total 16 apartment's and one apartment is for builder and rest 15 are purchased by various peoples and handed over to them , In Bangalore there is a practice to make a makeshift office for builder in the car porch/ground Floor and will be used by builder till the handing over to the association, But in this case builder said its his permanent office and its not handing over to association ,and even he placed his office board, First he said its illegal in the association meeting but after couple of months he registered the same office in his name and said its legal now, As I owns one apartment ,I want to know the legal ways to remove the builder office from the apartment, Builder nominated the president and under secretary and they are also supporting builder and president has business interest with him and under secretary is builders child hood friend. What should I do?
It seems to be illegal occupation, but it is the Association which has to take action against this illegality. If you have some people with you you can raise the matter in meeting. If that does not work, you can take legal action. Start by getting a proper legal notice issued to the association, and then wait for reply. Later if necessary you can approach court.
So long as your right to use and enjoy your apartment is not disturbed you cannot make any complaint against the builder or other owners
In what way you are concerned with that space It there any thing in writing in your document giving you some right over that portion Have you paid extra money to builder
Learn to adjust with the existing environment
Hi, If all the other apartment owners also feel the same as you and would like to take action on the illegal possession of the Builder, then please write a complaint to the Registrar of Societies of your jurisdiction with a memorandum signed by all other owners too to take action. Meanwhile also send a legal notice and if there is not correction by the owner on his part, then you can file a civil suit in the court of law for evacuation of his office from the parking area which is illegally occupied. Let me know for any assistance.
