Brother harassing to sell father's flat

hello sir, my father & mother got expired on 2001,we have one flat registered to his name,we are three two brother and sister,now my problem is my brother has stolen all the documents form that flat,he is just harassing me to sell that flat,but i dint want to sell it ,because i am having only one option to leave there,i have gone to police station to launch complaint ,but they refuse to take my complaint,what to do know for this?

You have to live amicably there or you have to purchase their shares to be able to live there. Otherwise the remaining option is to sell the flat and share the proceeds amongst yourselves because each of you has equal right over the flat.

If he has stolen the documents you can get a certified copy of the same from the land records office as well as if it is a sale deed then from sub-registrars office under whose area the flat is located if police refuse to take the complaint you can contact their immediate superiors such as commissioner or the person in charge of the police station and they will definitely help you out. please contact your local lawyer for further advice.
