Based on the facts stated, your cousin can certainly lodge a complaint with the MCD if the basement is being used in violation of the sanctioned building plan, Master Plan of Delhi (MPD-2021), Unified Building Bye-Laws, or applicable fire safety norms. Merely running an architect's office from a basement is not automatically illegal; its legality depends on factors such as the sanctioned use of the basement, zoning regulations, whether the property is residential or commercial, and compliance with building and fire safety requirements. If the basement has been sanctioned only for parking, storage or other restricted purposes, and is being used as a commercial office without the necessary permissions, the MCD can inspect the premises and initiate action, including sealing, if violations are found. However, your cousin should not use the complaint merely as a means to pressure the basement owner into selling. The complaint should be based on genuine violations supported by evidence such as photographs, the sanctioned building plan, occupancy certificate, or proof of unauthorized commercial use. Before taking any legal action, it would be advisable to obtain copies of the sanctioned building plan and title documents through MCD/RTI and have a local property lawyer examine whether the basement owner has exclusive ownership rights and whether redevelopment can proceed without his consent. The legal position will also depend on whether the basement is a separately owned unit or forms part of the common areas of the building

Merely running an architect's office from a basement is not automatically illegal. You can file a complaint with the MCD, but whether action will be taken depends on whether the basement use violates any regulations or rules. hire a good lawyer to consult.

You may respond as follows: Your cousin’s right to redevelop or sell the property depends upon the title documents and the nature of ownership of the basement. If the basement has been sold separately with independent ownership rights, the owner cannot be compelled to sell merely because the upper floors are being redeveloped. However, if the basement is only a common area or its use is contrary to the sanctioned building plan, different legal consequences may arise. As regards the architect’s office, running a commercial office from a basement is permissible only if it complies with the sanctioned building plan, zoning regulations, fire safety norms, parking requirements, and the applicable MCD building bye-laws. If the basement is being used in violation of the sanctioned plan or municipal regulations, a complaint can certainly be lodged with the MCD seeking inspection and action. If violations are found, the MCD may issue notices and take action, including sealing or removal of the unauthorized use. Before initiating any proceedings, it would be advisable to verify the sanctioned building plan, occupancy certificate (if any), and the sale deeds of all portions of the property to ascertain the legal status of the basement and the rights of each owner. This will determine the most appropriate legal remedy.

Whether an office can legally operate from a basement depends on the sanctioned building plan, land use, and applicable MCD building bye-laws. If the basement is being used in violation of the sanctioned plan or safety norms, a complaint can be filed with the MCD for inspection and appropriate action. However, such action cannot be used merely as a means to compel the basement owner to sell. Before proceeding, obtain the sanctioned building plan and verify whether the present use of the basement is authorized.
