apartment common gate blocked by flat owners car

24-Sep-2025 (In Civil Law)
Hi, I am from Hyderabad and I live in an HMDA/RERA approved apartment of 10 flats (2 flats each/ floor) in the L B Nagar area. There are 2 common gates but against one of the common gates 2 flat owners (co-brothers). They are not only blocking the common gate but also refusing to move their Car. Please advise.

You can first issue a legal notice to both owners demanding they clear the common gate, as per HMDA/RERA rules and Apartment Ownership Act. If they don’t comply, file a complaint with RERA and the local municipal authority. You can also approach civil court for an injunction to prevent obstruction of the common passage.

yes it is possible to make the inconvenience go away and they are not permitted to block a common way that is for every one to use ,if the problem persists with mere requests and they can be tried at a court
