I stay in an apartment, which is not been registered. But they collect maintenance of Rs 800/- monthly, for which no proper bills were shown also in addition to that they collect excess sum of money in thousands stating that to maintain adequate balance in account. No proper account were maintained. Now they are asking Rs 5000/- for CCTV, for which we said we don't require as we have our own CCTV which was which was installed in 2022. They alse started threatening that they will harm us.

An unregistered association cannot levy arbitrary charges without transparency. Demand audited accounts and receipts. If threats continue, lodge a police complaint and take appropriate legal action to restrain illegal collections.

From the facts stated, the apartment association/society cannot arbitrarily collect maintenance or special contributions without maintaining proper accounts and ensuring transparency. You are entitled to seek copies of the audited accounts, expenditure details, resolutions authorising the collections, and supporting bills/vouchers. If the association is unregistered, its authority to enforce such collections may be limited. Regarding the demand of ₹5,000 for CCTV, the liability depends upon the bye-laws or a valid decision taken by the members. However, if the CCTV is for the common area and has been duly approved by the majority, individual dissent may not by itself exempt a member from contributing. If the office bearers are threatening you with physical harm, immediately lodge a written complaint with the jurisdictional police and preserve any evidence of such threats. You may also issue a legal notice seeking accounts and restraining illegal demands, and pursue appropriate civil remedies if necessary.
