my great grand father purchased a house in 1910.he expired in 1940 and left behind 3 son.two son took village and other propert my grand father took house which was purchased by in 1910.in 2008 my grand father die with will to uncle's son.my grand father have two son one of my father and other his elder brother.my father file suit for null /void will(declaration & injuction) court decided property received by partition is self property.ow matter is pending in high court.
my question is i am not part of this picture can i implead or do fresh suit by which i also get some right to get in sue.because my father is not taking intrest in sue.

You can also fight on behalf of your father as it will be his right to claim. He cam also relinquish his tight and give it to you and then you can also fight for the same.

if the property is purchased by or acquired by great grandfather then certainly you have a right and you can file and application before High Court or any Court of law where the matter is pending to become party there in. if the property in which you are interested is purchased by your father by by his own earning that is called self acquired property and the person who has acquired property can execute a will in regard thereto in favour of anyone but nobody can will a property which he has acquired from his ancestors and has not acquired by his self earning.
