Agreement was registered among 3 parties, but not honored by 1 party

15-Sep-2025 (In Civil Law)
Hello sir/madam, Three siblings share ancestral property. An agreement was registered among them to provide land for road access to all of them in return for the electrical motor to be set up by party (A). Accordingly, the land for vehicular movement was provided by parties (B & C) to be made into a road. Even after the agreement was registered 2 years ago, and parties (B & C) fulfilled their obligation, party (A) did not fulfill. How do we go about this? Can Parties (B&C) cancel this agreement?

Dear Client, 1. Yes. Since Party (A) failed to perform their contractual obligation, Parties (B & C) can issue a legal notice to Party (A) for breach of contract and seek cancellation of the registered agreement under the Indian Contract Act. 2. They may also claim damages/compensation through a civil suit and request the court to declare the agreement void due to non-performance by Party (A). 3. Consult an advocate to discuss your case in brief. 4. You may schedule an appointment regarding your case by phone or email at your convenience. Thanks & regards, Priyanka Advocate Coimbatore

Since A has failed to fulfill the terms of the agreement even after 2 years — despite receiving the benefit of road access — B and C have legal remedies available. 1: Issue a legal notice to A demanding compliance of the agreement within a specific time (e.g. 15 days) or return the benefit received. 2: If A still fails, B and C can file a civil suit for cancellation of agreement or specific performance, depending on the nature of terms, before the jurisdictional civil court. 3: They can also seek an injunction to restrain A from using the road until obligations are fulfilled. 4: Maintain all records — agreement copy, correspondence, and witness details — as evidence for court proceedings.
