Agent not returning back my money, should I file police complaint

I gave x amount to 1 agent by RTGS & check . Now he is not giving back . Great confusion about police complaint or notice ? What's better?
You can file the police complain against the amount paid by you but the Agent have not fulfilled the exchange what is expected from your deal. You can file the case under section 420 of Indian Penal Code.

File complain FIR at police station for cheating to him under section 417, 420, Indian penal code 1860. OR if you have his cheque so you can complain before magistrate court under section 138 negotiable instrument act.
