When can I claim for child custody

12-Apr-2023 (In Child Custody Law)

I and my wife of two and half years are seperated but are not divorced. We have a baby girl of 9 months old. As I understand since the baby is only nine months old I cannot file for child custody. Is there any age after which I can approach the court for child custody? We both are working professionals and earn about he same. About our family, I stay with my parents and she stays with her mother who is handicapped with a slight limp. My wife's father and mother do not stay together as he stays with his first wife.

Child custody in case of separation is given to mother where the child is below the age of 5 years. You can claim for the custody of your child after the child attains the age of 5 years.
