School is refusing to accept the name change issued by government
05-Dec-2023 (In Child Custody Law)
Question: How to implement the name change in the school, even after published in the Tamil nadu Gazette. The school is refusing to make the name change. Background info: - My Daughter's last name was changed my (father of the kid) me, the name change was corrected in the Tamil Nadu Gazette. Now when I try to implement the name change in the school they are saying only if both parents agree for the name change then only we accept the change. - In the Tamil nadu Gazette application father (me) the only applicant, not mother. - My wife named my daughter without my consent and enrolled her in that school. We are living separately for the past 4 years, but no legal divorce. the name change was applied with mother's consent, but now she is not agreeing.

In this connection your wife would have either informed to the school concerned or she would have issued letter not to change the child's name. Since matrimonial relation is strained between you and your wife the school officials are are taking undue advantaage. You can approach civil court for direction.

It is not necessary to get the consent of your wife for changing the name. Once it is gazetted officially the school is borne by the contents of the same. However you need to engage the school to make them understand. If you fight legally you will win but your child will be undergoing the education in the school. Some times the school will be taking revenge and hence sort it out amicably.
