If the mother die while giving birth who gets the custody?

My wife given birth to a baby girl and she was died with a stroke.so,who will get the custody rights,grand parents (in-laws) or father?
The father has an absolute right to get custody of the child. The father should get custody by default but if there is any conflict you may file a custody petition under the Guardians and Wards Act. Normally, it would have to be filed before the court under whose jurisdiction the ward is currently residing.
