How to get my kid back he is living with in laws after wife's death?

3 years back my first wife expired. We had a kid who is 2 years old. After the death of the wife the kid is staying with in laws and recently I did second marriage, now i am trying to get my kid back they are denying to give my child back to me. How can i legally get my kid back?
You will have to file custody under the Guardianship Ward Act and seek custody of your child. The custody can be filed at the local jurisdiction where the child is residing.
