Can a father get custody of 2.5 years old child

My wife took my 2.5 years son with her to her parents and want to divorce me. She also filed GD at police station of domestic violence on me. Can i get custody of my son. Please help. On 29.3.15 she on getting angry with my 1.5 years old son threw him to bed such badly that my son’s leg got sprained which took around 2-3 weeks to recover. When my mom and myself told that how could she behave such roughly to her own son and she started using vulgar words also tried to hit me but since I was very upset with my son’s condition i pushed her and she filed case of slapping her on me.
