SECURITY DEPOSIT CHEQUE BOUNCE ...

I took an apartment for rent and paid the security deposit up front .. but there was some society issue with owner and we decided to cancel the deal .. the owner gave a cheque wich bounced .. it is now 30 days since we gve them the deposit and 13 days since we were supposed to take the possession and 3 days for the cheque bounce .. the owner is first asking for cheque and said will make an RTGS after that .. we have requested for an RTGS first .. he decines .. how can we handle this legally ..

Send a legal notice under Section 138 NI Act immediately. If unpaid after 15 days, proceed with a criminal complaint. Also consider a civil recovery suit. Do not return the bounced cheque without receiving your money.

You have to take legal steps against him with the help of a lawyer to create records. take it ahead legally with the help of experienced lawyer or else he may initiate false claim or case against you. Feel free to contact for further assistance.

If the cheque is bounce, you already don’t have too much time to think in this as Cheque Bounce is a time bound case, hence you can initiate by sending a legal notice under section 138 (Cheque Bounce), thn thr are many other things like possession of the property and the deposit amount etc to deal with
