Hello, Yes. You can put the date and amount on the cheque and present the same to your banker. The signed cheque is legally entitled to go for a legal battle provided that the issuer of the cheque must have issued the same towards discharge of some liability and you must prove this in court. In the absence of which the cheque bounce case is not sustainable. Feel free to contact me if you need any clarification.

A person who gave you the signed blank cheque has given you authority to put datee and present it. Sec. 20 of N.I.Act speaks about it. You can present it and after its bounce, you can legally proceed against him. But the burden would be on you to prove that he issued the blank signed cheque without dastee authorizing to put date and present it. The second option, you have is to pursue him and get a fresh cheque in presence of witnesses. Please see that the documents you had obtained to prove the debt you lent to him be preserved and filed in the court at the time of filing in court. In this attempt if you fails, you can present the blank signed cheque, and proceed against him.

Hi, Try to get it filled by the same person , what does he says for non making the payments now in time as agreed. If you are not getting any positive response then you can fill the details and then file the cheque in your bank account . After cheque is bounced then you have to send him the legal notice within 15 days and then file the case within 1 month under section 138 of N.I.Act. For further assistance you can call us through website.
