I am a aurthorised signatory Working as an employee in corporate firm. I signed cheques along with my ceo which hit bounced and the matter is in court. What defences can I have as an employee

in case of cheque bounce matters, the defence that a person in your position can take is that you are not the managing director of the company. in cases like yours, generally it is the managing director or a similar placed person who is held ultimately responsible.

as an employee, the defence that you can take is that you are not in charge of day to day running of the company. generally in such matters, it is the managing director or a similarly placed person who is held responsible.

If you are an authorised signatory and only followed the instructions of the management then you can simply say that you are only an employee and had no role in the dishonour of cheque.

The authorised signatory can't be held personally liable if he had no role in the transaction.

see there are two things, and by things i mean capacity in which you signed. Also the status of your company decides a lot. so i would suggest that you disclose nature of your company and then your capacity in company then there are ways out of this matter. Not to worry there are ways out.

Sir, please file reply in court and disclose all such things in your reply due to, cheque bounce is a criminal offence according under Section- 138 of the Negotiable Instruments Act, 1881. However, in case of a cheque bounce, the victim can file a criminal as well as a civil suit against the accused and is punishable by imprisonment up to two years or with monetary penalty or with both.
