Appeal against conviction by lower court in sessions court.

04-Nov-2023 (In Cheque Bounce Law)

I have been convicted of a chq bounce case in jalandhar and an appeal has been filed at sesions court. There was no consideration proved against the cheque and in fact the cheque has been misused by the holder. 1. If the sessions court does not over rule the lower court conviction, will I get bail to appeal to high court or I will be taken into Judicial custody immediately . 2. How can I get the appeal shifted from Jullundhur to some other court in Punjab . haryana or delhi .

Appeal cannot be transferred and moreover earlier while convicted by lower court the benefit of getting bail under crpc provisions had been availed by you and now you will be taken into custody and I can only get bail from high court

Yes you have to file bail before HC and to transfer case between districts then you have to file application before High Court and transfer between states you have to file application before Supreme Court,.,

Dear Sir,
the facts of your case and the judgement of the lower court are to be scruitinized and to be read thoroughly for the appeal purpose. In case of conviction by the sessions court, one is supposed to go to jail and can seek bail from the high court. meaning thereby, one has to be go to jail and then only can seek bail from high court. And if you are not satisfied with the sessions court jallandhar and want to get it transferred to come other state , then you should move to the Supreme court ( if you want to get it transfered out of punjab). In case you want to get it to haryana or some other city of Punjab, then you can approach High court of punjab and haryana for the same purpose. Rest , I could give better advise after going through the documents such as the evidences in lower court and the judgement of conviction.
