Q: Agreement to give remaining payment but not done yet

I sold out my property. And my property papers are with the bank. Buyer is asking to give in written that he will collect the papers and New sale deed is also done in his favour. But I have still 30 % of the total payment is pending. He will pay me my balance on receiving documents from the bank. Possession of the property is with me only. And New/Old sale deed papers are with him. He has also given one security cheque of the same balance amount and agreement on 100 rs stamp paper with witness to pay my balance money in cash and then only will take the possession. How far my balance payment is not done.

U can file suit for recovery and if some criminal action is required u may put the cheque in question and as far as agree my on rs 100 stamp paper is concerned , it must have been on stamp paper of rs 2000

Q: How can I ask my tenant to vacate the house?

My tenant is not paying rent on time. and is creating a problem. how can i get it vacated

You can file a suit for eviction under rent act but to get effective results get it filed under self need and that is the law of land as law favouring landlords in on verge.. There must be some bonfire need and along with it other ground for eviction would be non payment of rent

hello sir mughe bail ke bare main puchna hai ki mere mangetar ek decoity case main fas gye hai nd 6 month say upper tym ho gya hai ab bail lga rahe hai vo reject ho rahi hai baar baar ..nd jabki unka decoity case main vo nhi shamil na vo yha tha vo to aapne bhai ke marrige ki tyari main lge hue they ..mughe bail ka and ye puchna ki aise case ko kaise handle kre beksur hone ke bavjud vo befaltu ki saza cut kr rhe hai so plzz help me nd iske sath sath aur bhi case use pr dal diye

You have to follow proper procedure. File enquiry before senior officer of the police or get some directions from the concerned high court. Without special circumstances and subsequent events you cannot get bail by filing application again and again

Q: Appeal against conviction by lower court in sessions court.

I have been convicted of a chq bounce case in jalandhar and an appeal has been filed at sesions court. There was no consideration proved against the cheque and in fact the cheque has been misused by the holder. 1. If the sessions court does not over rule the lower court conviction, will I get bail to appeal to high court or I will be taken into Judicial custody immediately . 2. How can I get the appeal shifted from Jullundhur to some other court in Punjab . haryana or delhi .

Appeal cannot be transferred and moreover earlier while convicted by lower court the benefit of getting bail under crpc provisions had been availed by you and now you will be taken into custody and I can only get bail from high court

Q: Can Landlord threaten Tenant to throw him out of his shop

I have been tenant a shop from 27 years but owner want to throw me out  from the shop .he threatened me many times .he said he fall down roof at night nd throw my things out from shop.so I hired advocate nd court gave me stay order but he sold out shop so what should I do

Preposition once a tenant always a tenant always suits you and by operation of law you become tenant of new landlord and this subsequent sale does not effects your rights. So your rights are protected and subsequent landlord ha only one right to go against you and that is by due course of law
