Accused absconding under 138 NI and need to file new case under 420 IPC. One customer of mine is found guilty in case dishonor case and I have filed the case against him under section 138 of NI act. Case filed in dec 2017 and the progress of case are- e/r of warrant, plea, plea, plea, evidence, evidence, e/r of warrant continues. From last 4 hearings only police response on warrant is pending. What should I do now? My lawyer saying we have to wait for police response. He also said that accused might not present at the warrant copy address so police cannot arrest. It is pathetic to see that our law cannot provide justice properly. I was browsing online for case related to 138 NI and found one interesting topic on filing of case under 138 NI and 420 IPC for cheque dishnor and cheating resp. Should I file another case under 420 IPC? please help

There is provisions both in Code of Criminal Procedure u/s 483 as also under Article 227 of the Constitution of India exercising which the High Court directs the Learned Court below to expedite and conclude any criminal case or civil case within specific time frame. This way many of my clients got immediate relief from Calcutta High Court. All the best and regards
