Resignation from job without serving notice period and paying out
25-Aug-2023 (In Breach of Contract Law)
I joined a company two weeks back( one week training and one week on job). The organisation has an autocratic humiliating and extremely hostile work environment that is affecting me and new joiners badly. I chose to resign but there are two clauses of 50 day notice period or 1.5 lakh to be paid if notice period is not served. The company has some articles and it’s old employees speaking about its horrendous policies. I am least willing to go back to office. Can I resign without prejudice ? What can I write in my resignation letter to hold a good ground in court
The first step is to approach the HR department, tell them your concerns. Get their reply on mail. If that solves your problem then it is fine otherwise you may quit the job by writing them a proper letter addressing your concerns. Wait for them to initiate legal proceedings.
However, you need proper documentation of the nature of harassment and humiliation.
It depends on the the contract you have signed with the company, but usually such companies rules are not applicable on new joiners. I would suggest talk to your companies HR and give them a detailed excuse for leaving the company (make one). if possible please share agreement signed between you and the company.
