Can a bank send legal notice under section 17 for a loan which is 90 days past due

hi

it is unclear from your query under which law you have received notice.
if there's 90 days default, then your account has been classified as NPA.
then as per sarfaesi act bank can issue notice under section 13(2) for demand for entire outstanding.
