Harassment by bank to pay emi during waiver period

12-Jan-2023 (In Banking / Finance Law)
I have a personal loan and as per rbi notice I have a waiver period of 2 months - Nov and Dec 2016 (loan pushed out by 2 months). The bank is harassing us to make the payment for Dec (payment for Nov was automatically taken as per ecs) plus pay late fee. Is this legal or do I have the liberty of the 2 months?

Yes, the RBI notification pertains to dues payable between November 1, 2016 and December 31, 2016. However in order to give you a correct legal advice I need to look into your documents, you may have a clear legal remedy and can benefit from the notification issued due to the change in the policy. Dear Querist,
If u have the RBI guidelines then assert the same and bring to their notice that Nov and Dec.2016 is coming within the waiver period, if they don't agree then u can send a legal notice asking them to waive the said 2 months, inspite of it if the Bank does not waive, then u will have to file a consumer disputes case for deficiency of services and mental agony.
Regards,
Pratap
