What does jurisdiction of AFT means? I want to file a case against MoD's decision on my statutory complaint on non promotion. Can i file it at Jaipur Bench? Which bench is better for such cases?

Legally speaking There is nothing like which is better.Your case has to be filled as per the jurisdiction (area of control).it depends on where you are staying or from where the impungned order is issued.

In your case Delhi AFT can have jurisdiction as your impungned order must have been issued from Delhi as presumed on basis of what you have written.

Thank you

Hello,

The meaning of Jurisdiction is the place of filing an application before a particular bench situated in that place. An application is normally filed by the applicant with the Registrar of the bench within whose jurisdiction the applicant is posted or was posted at the time of the cause of action. The applicant can also file at the place where the order under question is passed.

In your case, you can file in AFT (Principal Bench), New Delhi if the order of MOD is to be challenged. You can also file at AFT Regional bench Jaipur if you are posted within the Jurisdiction of Jaipur or where ever you are posted. If The matter is promotion and if you are Officer (which is most likely), it is advisable to file it at AFT(PB) Delhi.

With Best wishes

Hi, in AFT you may file any cases related to your grievances which has not been addressed by your defence department. Hence, you may file your case at AFT. The appropriate AFT bench will be near to your place of posting. All the benches have similar jurisdiction.
