Terminated from service without any valid reason

I was invalided out of Air Force in 1976 as a matter of Neither aggravated nor Attributable to service , I am an Ex NDA from the pilots's branch and was given only invalidment Gratuity. Medical Board papers were not given to me. There was no Prior Disability while in NDA or post Commission in Jan 1972, and no medical disabilty was ever found earlier.There was only one instance of fainting on 30 March 1972 at A.F. Station Kumbhigram post an Air Maintnance Sorty in Mizoram. Kumbhigram was a declared war zone till 31st March 1972. In the last two years Air Chief has been giving no answer.Pl. advi

Based on the facts you have mentioned ,in my fair opinion you seem to have merits in your case as you have been medically invalidated out of service and you were SHAPE-1 when you joined the services and have also been granted invalidment gratuity.
Further since you have already made representations and you have not been granted relief you may now approach the AFT for relief.
Incase you had developed the disability during the war you may be entitled to WAR disability pension,however this opinion can be giving only on knowing the complete facts of the case.
For your information you can file the case in AFT,Delhi even if you are not residing in Delhi.
