Pension as per Last Rank Held and not as per retirement rank

14-Feb-2023 (In Armed Forces Tribunal Law)

I retired from the Indian Air Force in 2013 after having served a little more than 4 months after promotion to a new rank with 2 months in acting paid rank. But my pension has been fixed at the previous rank held and not based on the last pay drawn, as per VI CPC. Upon enquiry, I have been informed by IAF authorities that my substantive rank was not granted before my retirement. This appears to be in contravention to the recommendations of VI CPC implemented by the GoI. Can I appeal against this through the AFT?

Hi, It seems you have retired at the rank of JWO and you are getting the pension of a Sargeant.
The pension is calculated as per 50% of last pay drawn. If your pay is revised as per the rank of retired then you are entitled to the pension of your promoted rank.

Once you are promoted to higher rank it is for Air Force to accommodate the vacancy of the substantive promoted rank and you have no role to play. However kindly provide all relevant details to ascertain the exact cause of not granting the pension of promoted rank, which you held last. Regards

Hi,
Please explain in detail. As per the policy in vogue the active rank after 28 days of service becomes the paid one. Also the Policy after VI CPC says the same thing as you have mentioned. If you are not getting the deserved pension, then your case is quite fit for AFT.
