Extension of posting tenure on self medical grounds.

30-Oct-2023 (In Armed Forces Tribunal Law)

I came to Bangalore on superannuation grounds for 2 years. I am suffering from chronic kidney disease stage 3. From net it is found that Bangalore is beneficial to CKD patients due to its equival climate. Accordingly i requested for extension of my tenure here by 21 months i.e. to my superannuation. That's not agreed by authority. Can I get legal help to continue here till my superannuation.

The posting on superannuation ground is a welfare oriented, generally it is given for two years for the purpose of settlement after retirement.

However, it can be extended for further period on compassionate ground, in your case it is on medical grounds with recommendation of medical authorities. We need more details from you inform of your previous applications, date of retirement and medical documents etc.

Since your applicaton is already rejected it is suggested that you can file application to AFRO for reconsideration or you can also file a court case in Delhi High Court or Karnatka high court. Contact us for further assistance.
