Eligible for disability pension or not
09-Oct-2023 (In Armed Forces Tribunal Law)
Sir I am retiring on 31march2017. I am suffering from Hypertension and got diseblity 30% but not attributable /not aggravated by service by RMB.Can I get diseblity pension.
since the disease is not attributable to/aggravated by service, you are not entitled to any benefit unless you challenge the same and get the disability attributed to service. You will have to appeal first to the department against the RMB wherein it has been held that the disability is not attributable /not aggravated by service and then move to the Armed Forces Tribunal against such finding/order.
Please refer to your querry ,you can get the disability pension after you are released.Contact in personwith all the required medical documents and then it can be seen and said with cent percent surity. At the face of it you seems to be eligible.A proper court case has to be filed and it can pass an Judicial order in your favour.
