What to do if i have to appear in court after a legal notice

I have been receiving a series of legal intimations, from the office of sole arbitrator engaged by my personal loan bank demanding payback of the total outstanding amount on my loan acct. I have full intentions of paying back the entire amount and I have already spoken with the local branch of the concerned bank and have been paying EMIs for past 6 mpnths. Due to the circumstances I was facing I requested the bank to grant sometime for the same and also have replied to notices sent on my email by bank manager. The latest legal notice, from a series of 3, requires me to be present at Mumbai to face a lawyer in his office for Arbitration. Your suggestions and advice will be very helpful.

You can go there yourself or be represented over there by a counsel. It may be the case that you have informed your local branch about your intentions but the message has not yet been forwarded so you received this legal notice. In such scenario you can give an undertaking before the arbitration tribunal regarding your intentions and a settlement can be reached between the parties.

Based on the facts herein, it would be advisable to issue a letter to the arbitrator along with all pertinent information and inform the arbitrator of the recent developments. Subsequently, an application/ undertaking from the bank stating that the amount is being repaid will assist in resolving the situation.
