Need Lawyer for Appeal & Interim Stay In Tribnal on Salary Deductions

21-Aug-2025 (In Arbitration Law)
I am a government school teacher earning ₹1,17,320 gross salary and ₹45,388 in-hand. Currently, ₹52,500 is already deducted monthly for previous loans. Recently, an Arbitrator appointed by Delhi Cooperative Bank imposed a lien of ₹20,000 on my salary account, leaving only ₹25,000 in-hand, out of which ₹21,000 goes for house rent, leaving me with just ₹4,000 to manage family expenses. Additionally, two pending deduction orders of ₹12,000 and ₹10,000 may start anytime, increasing deductions to ₹74,500. Under Section 60 CPC, only ₹14,800 is legally attachable. I urgently need a lawyer to file an appeal and interim stay before the Delhi Cooperative Tribunal to stop illegal deductions, remove the lien, and protect my salary so I can manage survival expenses for my family.

In your case, the deductions being made by the bank are clearly excessive and go beyond what is legally permissible under Section 60 CPC, which protects a substantial portion of your salary from attachment. The most effective step for you right now is to file an appeal before the Delhi Cooperative Tribunal against the Arbitrator’s order and simultaneously seek an interim stay to immediately halt the lien and further deductions; while doing so, you should present your salary slips, bank statements, rent agreement, and details of your family expenses to establish the hardship being caused. Alongside this, a legal notice will be issued to the bank pointing out the illegality of its actions and warning it to withdraw the unlawful deductions, and if urgent relief is still required, we can also approach the Civil Court under Section 9 of the Arbitration and Conciliation Act to secure protection of your salary.

From the facts, your salary deductions are clearly exceeding the legal attachable portion under Section 60 CPC. The Arbitrator and Bank cannot bypass this protection. You have strong grounds to file an appeal before the Delhi Cooperative Tribunal seeking interim stay on the lien and deductions. The Tribunal can be requested to restrict recovery strictly within the statutory limit and direct release of your attached salary. Immediate filing is important to protect your subsistence needs. I can assist you with drafting and filing the appeal, stay application, and representing you before the Tribunal to ensure your salary is safeguarded.
