You are entitled to challenge the arbitral award dated March 25 under Section 34 of the Arbitration and Conciliation Act, 1996, before the competent court at Bangalore, as the seat of arbitration appears to be there. The petition must be filed within three months from the date of receipt of the award, with an additional grace period of 30 days if sufficient cause for delay is shown. In cases involving bad service by a securities broker, if you possess strong documentary evidence and can demonstrate that the award was either patently illegal, violated the principles of natural justice, or was contrary to the public policy of India, the challenge stands on firm legal grounds. While physical presence is traditionally required for filing and hearings, you may request for the proceedings to be conducted through video conference, citing reasons such as travel cost and time constraints, especially since courts in Karnataka permit e-filing and are increasingly accommodating virtual hearings. It is advisable to engage a local counsel in Bangalore to assist with the filing while you participate remotely.
