Anticipatory bail is a direction to release a person on bail, issued even before the person is arrested. It is only issued by the Sessions Court and High Court. And there is no need for the accused to be physically appear before the court on each and every date unless and until directed by the concerned court.

Anticipatory bail मिलने के बाद आरोपी को पुलिस जांच में सहयोग करना और ज़रूरत पड़ने पर कोर्ट/IO के बुलाने पर हाज़िर होना ज़रूरी है। गवाह की ज़रूरत इस स्टेज पर नहीं होती, यह केवल ट्रायल में होती है। अगर बिना वजह हाज़िर नहीं होंगे तो जमानत रद्द हो सकती है।
