Anticipatory bail is a direction to release a person on bail, issued even before the person is arrested. It is only issued by the Sessions Court and High Court. And there is no need for the accused to be physically appear before the court on each and every date unless and until directed by the concerned court.

Anticipatory bail मिलने के बाद आरोपी को पुलिस जांच में सहयोग करना और ज़रूरत पड़ने पर कोर्ट/IO के बुलाने पर हाज़िर होना ज़रूरी है। गवाह की ज़रूरत इस स्टेज पर नहीं होती, यह केवल ट्रायल में होती है। अगर बिना वजह हाज़िर नहीं होंगे तो जमानत रद्द हो सकती है।

Anticipatory bail (Section 438 CrPC) mil jaane ke baad bhi police investigation jaari rakhti hai aur court ke bail order mein yeh likha hota hai ki jab police bulaaye to mulzim investigation mein sahyog kare aur hazir ho. Jab charge sheet file ho jaati hai to case trial court mein chala jaata hai aur uske baad mulzim ko har tareekh par court mein hazir hona padta hai jab tak court use exemption na de de. Agar mulzim hazir nahi hota to court uske khilaaf bailable ya non-bailable warrant jaari kar sakti hai. Gavahon ki zarurat tab padti hai jab trial shuru hota hai, jab prosecution apne gawah pesh karta hai aur defence unka cross-examination karta hai. Iska matlab hai ki anticipatory bail milne se sirf itna hota hai ki police turant giraftaar nahi karegi, lekin mulzim ko case mein poora sahyog dena aur trial attend karna zaruri hota hai.
