Q: Divorce / Annulment of marriage

My brother got married in 16th June 2019 and considering the fact that the family of bride is alleging us of doing the torcher which we consider to be the responsibility of the bride. Please suggest how can we get a divorce or do the annulment of this marriage. Note that the bride is not ready to accept the divorce. 1 year separation should be there for the divorce process and if you want to file case against the harrasment and cruelty you can file domestic violence and 498 against the husband and hia family you can claim maintenance also from husband

Q: Demolition of shop by BMC without notice

My shop was demolished by BMC for pipe line protection.. without notice they demolished my shop.i have BMC letter where they approve my shop as legal but without allotment of new location it was demolished.since last three year I am visiting multiple time but every time getting responses as waiting for approval. What should I do?

you can take stay on bmc action and also you can get the compensation or you can claim for your property if the property is in legal so you can apply by court for your rights and you can take the order from the court to take the action against bmc

Q: Legal remedy to challenge contested divorce filed by wife

My wife want divorce from me. In the counseling period they send her back to my home for three months.but in that period there is no changes in her behavior and also mine. Now she wants divorce from me but I don't.she left my home also.what should I have to do?

She can not take the divorce if you are not ready the court will take the mediation for you and it is in courts hand to take the decision to pasa the order for divorce or not if you are ready to stay with your wife then the court will not ask your wife why she don't want to stay with you

Q: Can father file for custody of child after the period of 12 years

Hi I was married in august-2004,After that my son was born in july2005.After six months, my wife went to her home with my son and refuse to come back and file a case 498-A .After that our division took place in jan 2008.I have not even met my child since april2006.Because my dad did not want that a small child be separated from his mother, so I have not filed any case that time.After that, my second marriage was held in 2010. I have a 5year old daughter and I have gradually convinced my wife for file a case for my son.Can this thing go against me that why I file the case after such a long period aprox 12years.

Yes you can file the application to take custody of your son but before taking the custody you have to prove that your wife is not taking the care of your son and also you have to prove that your wife is not able to take the care of your son so you can file the custody for your child

There is a legal fees which you have to pay to lawyer and if you want maintenance to satisfy your daily needs you can file seperate application in the court and you can demand the maintenance for your daily life and also you can demand for your residential place where you can stay with your son
