Q: One sided divorce from my husband. I dont know where he is living

Hello i am living in australia i got marry to my spouse in nov2017 in india. He came into australia july2018. After that we were in contact for 3months from october2018 i don't know where he is. Can i get divorce in india for this. Or much approx does it cost. U can get in Australia as well but here i don't want to get iwant to clear everything in india.

If you want to file divorce against husband then you can file divorce through Indian Court or Australian court if you take divorce through Indian Court there are two way to get a divorce first is-- if your husband returned to India then you take the mutual divorce from him. the divorce should be final after two statement . this case the cost will be come to at least 20000 depend advocate. second -----you can also apply a single divorce under section 13 Hindu Marriage Act. this case take slightly longer time but if your husband does not reach Court after repeated calls to the court , then the Court is one -sided divorce is final discus the cost will come at least 30,000 depend on advocate. There is advice option------------- you don't worry there is a lot of love for a girl to file the case in court. I would advise that his family who lives in India should be asked where his son is if they do not tell about their son . they should be given notice to arrest by police. your husband will definitely to visit his parents .

Q: Rights in father's property after divorce of his parents.

Hello Sir/Madam,I have a query regarding a child's right in father's property after divorce.Me and my wife were legaly separated via MCD in 2017.She has the custody of child and all the settlements have been done in divorce.My question is can A child claim in my property after he become adult.(18 years old) ?Please guide.ThanksManveer

hello Manveer in both wife and husband took a divorce mutually through a court. In divorce statement if you said that after divorce my wife and child have no right to my moveable or immoveable property because I had paid a lump sum amount in a court for wife and child . so child after 18 year cannot claim a father property even movable and immovable. can you send a copy of divorce?
