Q: Property fully maintain by me for 25 yrs But owner want it now
A property was verbally given to me. I was fully maintaining and repairing the property. The owner never came to have look at property for the last 25 yrs. Even the property tax was paid by me. Now he wants the property back as it is still in his name. Can he legally claim the property.
Advocate N. A. Rangapur answered
Mere verbal permission, long possession, maintenance, repairs, or payment of property tax do not by themselves transfer ownership, and since the property still stands in the owner’s name, he can legally claim it; however, if you have been in continuous, open, exclusive, and hostile possession for over 12 years without acknowledging his title, you may claim ownership only by adverse possession, which must be strictly proved before a court—otherwise, your possession will be treated as permissive and you can be lawfully asked to hand over the property.adv.
