Yes all the first class legal heirs become owners of half portion. All legal heirs have to give relinquishment deed in favour of mother than only mother will have the clear title and can sell the same.

Hello , you and your husband have to file a petition of divorce on mutual consent together alongwith affidavits . both of your statement s will be recorded in the court . then after 6 months a second petition will be filed and then simillary both of your statements will be recorded again n then ur divorce will be final .
Q: Married a girl but I have no proof can I stop her from second marriage
I married a girl in a temple but we didn't registered our marriage not we have any photos for the same, I just have audio recordings where she is accepting that she has married me and few photos together and bills of hotels we went together. Can I stop her from doing 2nd marriage legally?
