Q: Property is on the name of firm whose 1 out of 2 partners is dead

We have industrial plot which is on the name of the firm through conveyance deed. The firm had 2 partners and a partnership deed was made according to the partnership act. The two partners were HUSBAND and WIFE. Husband died on December 2005. Now what about the 50% share of her husband? Will it get transferred on the name of her partner wife or all the legal heirs?

Advocate Ishtneet Bhatia answered
the remaining share of the deceased partner will be transferred equally in the name of legal heirs and if they agree to transfer the share in the name of wife then they can do so and the wife has to dissolve the partnership firm as the minimum requirement of partner as per act is 2 partners

Q: Stat Resignation and clear my dues

Hi I am Dr. Deepika, 24 year old and I am serving in grecian hospital mohali sector 69 , punjab from last one year as a medical officer . I got increment letter in 1 June 2021 of 30k as my previous salary was 21k . But still I didn't get any salary as they promised ( got same salary 21k in June and 25k July, 21k in August ). Even they didn't pay September salary yet . Despite of this I get mentally torchered, boss insulted me a lot in front of all employees. This all make me mentally torchered so I just wanna give a stat resignation . But how can I get my previous salary? Can u please tell

Advocate Ishtneet Bhatia answered
As you were the employee of the company you have the rightful ownership on the appreciation as well as salary given to you. You can claim the previous salary even though you have left the company and can also claim the compensation for mental harassment along with your salary. Because it was the conditions due to which you have resigned from the company , in your case you can claim increment salary along with compensation for mental harassment/ torture as well as previous salary as promised to you by your employer. You can give a legal notice to the company as well as your employer who has harassed you after that file a suit in labour court for your last salary as well as compensation for mental harassment or torture
