I am wife of an NRI usa husband. He sometimes calls me, sometimes not. I am staying at my parents’ home. He said, “Whatever you ruined, your mother ruined the house too. Go home, everything will be yours.” He is not supporting me or my newborn baby. my mother gave gold to fathrr in law mother in law i need that gold to. Please guide me step by step for filing case, getting maintenance, child support, and recovering my golf. Free legal help nee
Advocate Pankaj Kumar answered
Since your husband is not supporting you and your newborn child, you can file a case for maintenance under Section 125 CrPC for yourself and the child. The court can direct your husband to provide monthly financial support. You can also file a case under the Protection of Women from Domestic Violence Act, 2005 seeking maintenance, residence rights, and protection orders. If the gold given during marriage is with your in-laws, it is considered stridhan, and you have the legal right to recover it by filing a complaint for recovery of stridhan and criminal breach of trust. Even if your husband is an NRI and staying in the USA, the Indian court can still proceed against him if the marriage took place in India or you last resided together in India. It is advisable to consult a lawyer and initiate proper legal proceedings for maintenance, child support, and recovery of your stridhan.
Q: How Can I Complaint Against NBFC Company to Which Authority?
Please help..
Advocate Pankaj Kumar answered
If you have not used the Pay Later facility, the company cannot compel you to place an order to deactivate the service. You may send a written request through email asking them to close the account and keep proof of communication. If they still fail to deactivate it, you may file a complaint before the Consumer Commission for deficiency in service and unfair practice. You can also raise a grievance through the RBI/online consumer grievance portal against the financial service provider.
Q: House related issue jo laal dori mein ata hai
Mein village bodiwala Kharak Singh, district Muktsar, sey hun mere father ki do marriages hui thi first marriage sey ek beta hai or mere father key first wife ki death k baad meri mother sey shaadi hui.mere father key death k baad.unki govt job bade bete ko first wife sey hai jo unko mili or job or marriage k baad voh hamse alag ho geya.ab voh hame pareshan kar raha hai ghar mein sey hissa mang raha hai hmare paas sirf jeh hi rehne ka tikana hai.hamra ghar Village key laal dori mein ata hai.
Advocate Pankaj Kumar answered
You may first verify whether the house in Lal Dora is ancestral or self-acquired property of your father. If the property belonged to your father, then all legal heirs including children from both marriages may have a share under succession law. However, your rights and possession can be protected depending on the nature of property and revenue record. The proper course is to examine the ownership documents and, if required, file appropriate proceedings for declaration or protection of possession.
Q: NRI mutual consent divorce - Hindu marriage Patiala - both abroad
I am a Hindu NRI in Mexico. Wife is Sikh (HMA applies). Married Nov 2010, Patiala. Registered under Punjab Registration Act 2012. One daughter age 13, also in Mexico. Wife is here on dependent visa. Marriage has had differences for years. I want to file mutual consent divorce under Section 13B. Need lawyer experienced with Patiala Family Court and NRI process. Questions: 1) Can entire process be done via PoA and video conferencing? 2) Cooling-off waiver possible? 3) What are your fees? 4) Do you
Advocate Pankaj Kumar answered
Yes, your case can be filed for mutual consent divorce under Section 13B of the Hindu Marriage Act before Patiala Family Court. In NRI matters, the process can generally be handled through a duly attested Power of Attorney in favour of a lawyer, and courts also allow appearance through video conferencing when required. The 6-month cooling period can also be waived by the court if both parties have been living separately for a long time and settlement terms are already finalized. Proper drafting of the petition and settlement regarding child custody and other terms is important to avoid delays.
Q: Remove FIR after resolution ???
I have 420 fir still under police charge cheet is not filed yet we have mutual agreement with other party now they want to take off the FIR what we do next and remove it from online
Advocate Pankaj Kumar answered
Since the FIR is under Section 420 IPC and the charge sheet has not yet been filed, if both parties have reached a mutual settlement, you can file a petition before the High Court under Section 482 CrPC for quashing of the FIR on the basis of compromise. Both parties will need to appear and confirm the settlement. The FIR cannot simply be removed from police records or online without a court order.
