Questions Answered by Advocate Gowtham
Q: Legal heir certificate copy issue
I applied for legal heir certificate but it got rejected and remarks says it was already there. My brother's family has took that without adding my name it seems.I want a copy of that certificate. My mother was deceased in vellore but record says certificate was issued in chennai which is impossible. Now i want a copy to check whether my name is included in that or not. If not so what kind of action can I take legally. And how can I get that already existing copy of certificate.
Advocate Gowtham answered
You can request a copy of a legal heir certificate through an RTI application. With proper supporting documents one can approach the Tahsildhar for inclusion of name in the Legal Heir Certificate. If not appeal to the RDO or District Collector. They will verify the claim and issue a fresh one after cancelling the one already issued. If not, the best is to seek legal remedy in the court
Q: Fear of false dowry harrasment case
My son had an affair with a girl of different religion and got married 2 years back, they have a 1 year old son, currently they are not in good terms, i fear that a fase dowry harrasment case may be filed against our family, how to safeguard us
Advocate Gowtham answered
Since the offence is non-bailable, it is advisable to move an application for anticipatory bail at the earliest. If there is any element of blackmail or coercion from the other side, appropriate legal action, including filing a counter-complaint, may be considered. If the circumstances permit, exploring mediation could also be a practical option
