Visa got rejected no refund from consultancy company

I have filed H1B visa on MAR 2015 in Oreng consultancy in vadapalani.I have transferred 75000 from my account to the consultancy account. We have made agreement between me and the manager. If i would not get select in the H1B visa lottery. he would return the same 75000 to me after 3 months. Its been more than one year. They didnt return the money. whenever i ask him he keep on saying some execuses. I have lost the hope. Please help me to file a case
When you paid the money, did you sign any contract? If ye,s we will have to examine the terms. Even otherwise, if you haven't signed the contract, then also we will have to examine the terms.
