Borrower refusing to return money what can be done

21-Mar-2023 (In Recovery Law)
Hi, One of my friends borrowed around 3 lakhs from me and he is not returning money. I don't have documented proof as I gave him in cash but I have the person as proof who handed over the money to the borrower. Is there any chance to file a case for recovery and what is the possibility of winning the case.... Thanks

You can send him a legal notice demanding the payment of the debt and if he still not complies to the same then, you can file a recovery suit against him in the court. Also, regarding the probability of winning the case, as we all know that legal proceedings are not predictable thus, one can not know the possible outcome the same, however, you are entitled to the recovery of the debt as you have a witness and the proof of transaction i.e, the borrower must have made the payment and witnessed the lending of money, so you are eligible to claim damages and payment of the said debt.
