Who be be liable for the loss is it insurance company or the car owner

One of my friend was driving car and met with an accident with a Lady driving Scooter. After admitting in the hospital that lady declared dead by Govt : Hospital. The car RC is in the name of Ltd Company and Insurance is of Director other firm (Not tranfered in DTO record) .Sold in books only. Is insurance company pay the claim .if not who will be liable to pay .?
In case of a motor vehicle Accident the Insurance company pays the Compenstion to the victim provided the vehicle had a valid insurance policy on the date of the accident and the driver of the vehicle had a valid driving licence.
