Road accident person died how to claim for compensation

My relative died in road accident on 12/08/2017.  Age:44 Work: Insurance agent (Vehical) He was on his Honda Shine bike ,he was hit by Maruti Omni from back.He fell down and car driver drove car over him. Both front and back wheel were passed over his chest. Multiple fracture and internal damage caused his death when brought and treated in hospital. Facts: 1.Omni is not insured 2.Omni registration was expired in 2014 3.Driver was not owner 4.Owner lives in Bhopal 5.Driver don't have licence. 6.Mr.Rajesh had valid licence and Registration and Insurance of bike Mr.Rajesh Prajapat have left 3 daughter and wife 1 daughter 18yr 2 daughter 15 yr 3 daughter 4 yr Wife 38 yr Family don't have enough money for survival of family. He was the only earning person in family. Kindly suggest. FIR lodged with vehical number but no driver name. How to claim for compensation?

You should file the case for claiming compensation against the owner of the vehicle and the unknown driver. Since the vehicle was not insured therefore you don’t have the option to make the insurer the party to suit and you can only proceed against owner of Omni and the driver. Secondly, it is really important to bring it to the kind notice of the judge before who the suit is placed (once it is filed) that the deceased was the sole earning person in the family and he has left his wife and 3 daughters who are unmarried. This will help you to claim more amount of compensation on this ground.
