Paid advance but service not delivered , what legal option i have?

Hello There, I have one vendor for marble in Jaipur, he sent me quote on email and i made advance payment of 35k and now he didnt even sent the sample and not responding what legal option i have, as i am based in Noida.
Send a notice by advocate ..applied section 80 cpc ..give a further 15 days. Or send back money if he is not reply any answer filed the sue in consumer fourm.. then filed the sue maybe likely he's back ur money ..

Please make sure that the disbursment of payment must be evidential so that you may claim a remedy and it is a case of non performance of part duty so you please consult an advocate who will make a legal notice from you side and if it not works... he will file a complain
