Delivery of AC done but installation not provided by company

I have purchased an ac  on 7th April which was delivered on 9th April. The expected installatiom was between 9th to 14th April. But today is 18th and the ac still not installed. Everyday one call comes, telling me that your ac will be install today they keep lying that our technician has just left office for your location and many more lies. My wife is ill and we are unable to sleep at nights due to temperature. Today i have called them, now they are becoming rude, when i told them i will file complaint, the lady operator said "DO what ever you can". Now my question is, I have there phone recordings, bills and all things, can i file complaint against them under "after sales service not provided" and if yes then against whom the company or service people?

Yes, you can file a complaint against the company under the Consumer Protection Act, 2019, for deficiency of services. You can also approach the consumer forum and file a case against the company for not providing adequate after-sales service.

You can always file a complaint angast any such behaviour of the service provider as well as the company.
You can pray for whatever you demand as relief and so let the court adjudicate the same.

Yes you can file a consumer complaint against them. It will be best if you can make both of them as the party to the dispute as at times, there is an inter-se adjustment between the company store and service provider about the installation. You can array them as Opposite Parties 1 & 2, affix all the bills you have received from them and ask them to pay compensation jointly & severally.
The usual arrangement between AC providers and customer is that the installation except any materials to be put will be free of cost. So in case you are also planning to get it installed from outside, pay the outsider and later recover from company/service provider, then you may need to check for if any document or conversation that you may have had which says installation except materials will be free.
You may send a legal notice first and if they do not respond and/or install, file a consumer complaint before District Consumer Forum.

Hi,
Yes we can file a consumer case claiming compensation for mental torture, mental harassment , non performance of work and also can give a legal notice for the same.
Company as well as the service worker will be party to the case.

Sir, you are fully competent to file a suit against them( both company and service provider) as company authorizes the service provider or pay to them for their service to their customers. File a suit against them. U will surely get compensated with penalty over them. Best of luck.
