Company did fraud with us took money did not deliver goods

Dear sir, Our matter is that we have purchased a machine value RS X from jaipur company. We have made 50%payment against his quotation by our current account cheque. Now seller is not giving any response last two months even not pic the phone calls. So plz advise what we should do now for our money recovery?
Immediately send him legal notice & thereafter file a case for specific performance.
