Can I sue ecommerce company for not delivering product on time

I bought a shoe off a popular eCommerce company. They delivered a wrong item. So I returned it and asked for a replacement. They sent a wrong item again. Now I asked them to return my money and stop wasting my time. They said they'll give the right item this time. After a week they said they don't have that item in store and returned my money. This whole ordeal took almost a month & the item that I actually ordered (the one that they said was not available) was shown as "in stock" the whole time. Now, can I Sue them for misleading marketing techniques and wasting my time & energy?

Yes you may do so. You will need to file a consumer complaint before the appropriate consumer court. Whether your case will be filed before the district, state or national consumer forum will depend on the amounts that you claim as damages. You should also take screenshots of the website to use as evidence in your consumer complaint as well as keep all the emails exchanged between you and the e-commerce company.
